During a sit in Kaduna on Friday the 30th of June, 2017, A Federal High Court in Kaduna fixed the 6th of July 2017 for delivering a Judgement of a suit filed by Sheikh Zakzaky’s Counsel against Nigerian Army, the Attorney Generla of the Federation and Kaduna state government for killings of Sheikh Zakzaky’s 3 sons, his followers and destruction of properties.
The prisiding Judge of the Federal High Court, Justice Saleh Musa Shuaibu, said “I will concern myself with the issue of alleged destruction of the houses and properties of the applicant by the Army and the killings of his children which were brought before me. And all these have been covered by the written addresses, exhibits and affidavits of counsels and which I have gone through.”
It could be recalled that Justice Gabriel Kolawole of the Federal High Court in Abuja, had ealier delivered judgment late last year against unlawaful denetiona of Sheikh Zakzaky and his wife which is equivalent to infringement of the fundamental rights of the Sheikh and his wife. Justice Kolawale ordered for release of the Sheikh and his wife within 45 days, and to secure an accommodation for them in additon to the payment of N50 million damages to them.
During the case hearing in kaduna, the cousel to the Army and Chief of Army Staff, Mr. Biola Oyebanji urged the court to dismiss the submission of Okoye who is the cousel to Sheikh Zakzaky becasue of a similar case in Abuja Court. Justice Saleh said the case in Abuja court is different form the case he is handling now. He futher asserts “I have the written addresses of both the applicants and respondents in this case before me, and I have also gone through the judgment of my learned brother in Abuja, Justice Kolawole which deals with the unlawful detention and fundamental human rights of El-Zakzaky and his wife."
The 6th of July 2017 has been fixed for passing judgement of the current case with Kaduna Court as the counsels on all sides presented thieir submissions and presentaitons.
