Sheikh Zakzkay vs Army, COAS, AGF, AG: hearing fixed for 9th November

Hearing in the case before Justice Shuaibu of the Federal High Court Kaduna between the revered leader of the Islamic Movement in Nigeria (IMN) Sheikh Ibraheem Zakzaky has been fixed for the 9th of November 2016 before which all process might have been regularized.

The case in which the Nigerian Army and its Chief (COAS), the Attorney General of the Federation (AGF) and the Attorney General (AG) of Kaduna state are first, second, third and fourth respondents respectively, has been slowed as a result of several judicial activities on the last judicial calendar.
Meanwhile, Counsel to the Nigerian Army and its Chief Barr. Usman Abdullahi has been instructed by the High Court Judge to regularize the presentation of his counter affidavit and motion within a period of one week to allow the applicant respond to it duly. His motion for an extension of time to properly respond to the affidavit was however granted and was given seven days within which regularize.
The motion filed by the Counsel to the AGF Barr. T.D Abbey for an extension of time to respond to the affidavit filed by the applicant was also granted as was an application for time extension to respond to the motion filed by the Counsel to the AG Kaduna state filed by the Counsel to the Applicant Barr. Maxwell Kyon.
Justice Shuaibu also told the applicant to present a further affidavit before the court in response to issues raised by the respondents in their counter affidavits within the stipulated period.
The same processes was adopted in a sister case between the wife of the IMN leader Malama Zeenatu Ibrahim and the same set of respondents for which the 9th of November 2016 was also fixed for hearing.
