Court fines IG the sum of N100m over the arrest, the killing of ‘Free Zakzaky’ protester in Abuja

The Federal High Court in Abuja has delivered a Judgement regarding the arrest by the Nigerian Police of one Pro Zakzaky protester Jafar Muhamad on 22nd of July 2019  and his subsequent killing and dumping at Gwagwalada Teaching Hospital on July 24th, 2019 by SARS Police.

The Court ruled that the arrest and the subsequent killing of the Protester were illegal and is termed as gross violation of his fundamental rights as contained in Section 33 (1) of the 1999 constitution of Nigeria.

Justice Abubakar stated that Naziru Isah had provided evidence that his brother, Ja’afar Muhammad, was shot by the police and sustained injuries while participating in a peaceful free Zakzaky protest at the Federal Secretariat, Abuja, on July 22, 2019.

Justice Z B Abubakar, therefore delivered a judgment in response to a case filed by Naziru Abdullahi with suit number FHC/ABJ/CD/409/2020. In the Judgment, the Court gave an order directing the Inspector General of Police to pay the applicant the sum of N100,000,000.00 (One Hundred Million Naira) only for the unlawful detention and killing of Ja’afar Muhammad.

The Court also gave another order directing the Inspector General of Police and the Medical Director of Asokoro District Hospital to release the corpse of Ja’afar Muhammad to his family for immediate burial in accordance with Islamic rites.
